Permitting & Wind Load

The City’s own building division

Delray Beach is an incorporated city, so a new house here is permitted through the City’s Development Services Building Division at 100 NW 1st Avenue, Delray Beach, FL 33444 (561-243-7200), not the Palm Beach County office that handles Loxahatchee and The Acreage. The City has been rolling out an eServices portal and an ePlans digital plan-review system for submittals. We hold the permit as the licensed contractor and carry the build through every inspection to the Certificate of Occupancy. Before we write an estimate we confirm your parcel is inside city limits, because some nearby mailing addresses sit just outside the line in unincorporated county territory.

Palm Beach County is inside the Florida Building Code’s Wind-Borne Debris Region, so every opening on a new Delray Beach home must be impact-rated or shutter-protected. The county’s published ultimate-design-wind-speed maps (Risk Category II) put oceanfront and Intracoastal parcels in roughly the 170 mph-and-up band, stepping down toward the mid-160s as you move inland toward I-95. The exact figure depends on the parcel and the code edition in force, so we check your address against the map before we spec a window, door or roof system.

Lots, Zoning & Flood

What changes the build on a Delray Beach lot

Delray Beach lots fall into three broad types: infill and tear-down parcels in the older neighborhoods near downtown, established non-gated streets such as Lake Ida and Osceola Park, and larger parcels inside the gated communities further west. Each is governed by the City’s Land Development Regulations for its zoning district, which set the setbacks, height and lot coverage your plans must meet. We read the survey against those rules before design, so the house you draw is the house the City will permit.

Flood zone and base flood elevation are assigned parcel by parcel on FEMA’s flood maps, and they set the finished-floor elevation and can change the foundation design and cost. We look up your parcel before design begins and never assume it from the neighborhood. On a tear-down lot we also handle the demolition and site preparation with our own equipment, so the lot, the structure and the roof stay under one license and one phone number.

Historic Districts & HOA

Five historic districts, and the gated communities beyond them

Delray Beach has five locally designated historic districts: Old School Square Historic Arts District, Del-Ida Park, Nassau Park, the Marina Historic District and the West Settlers Historic District. Inside them the City’s Historic Preservation Board reviews exterior work, so a new house or addition has to clear that review before a building permit is worth filing. Del-Ida Park, platted in 1923 with a diagonal street grid of Mediterranean Revival and Craftsman Bungalow homes, is among the strictest.

Further west, large gated communities such as Kings Point and Rainberry Bay run their own architectural approval, and exterior work typically routes through the association even when the owner is paying. We identify which review, historic, HOA or both, applies to your lot before we finalize a design, so the plans are not redrawn after the fact.

Proof

What we can — and can’t — claim in Delray Beach

We have no confirmed, named Delray Beach project to show you, and we will not invent one. What we lead with instead is the credential stack: Florida State-Certified General Contractor license CGC1528750, which means we may contract in any Florida county without separate local licensure; EPA Lead-Safe Certified Firm #NAT-F122701-2; and BBB A+ accreditation. We hold a Palm Beach County Business Tax Receipt, which covers Delray Beach as it sits inside the county; we do not hold, and do not claim, a Delray Beach municipal receipt.

The owner does new construction and commercial, institutional and high-rise work, including million-dollar builds, and is a certified energy engineer: the envelope, insulation, air sealing, impact glazing and HVAC on your Delray Beach home can be designed together and then proven with a blower-door test. Every job carries a written one-year workmanship warranty. For the full build sequence see our new home construction guide.

Questions, Answered

New home construction in Delray Beach, frequently asked

Who issues a new-home building permit in Delray Beach?

The City of Delray Beach, through its Development Services Building Division at 100 NW 1st Avenue (561-243-7200). Delray Beach is an incorporated city, so it does not route through the Palm Beach County office. We confirm your parcel is inside city limits first, since some nearby addresses are in unincorporated county territory. A licensed contractor holds the permit and carries the job through to the Certificate of Occupancy.

What wind speed does a new Delray Beach home have to be designed for?

Delray Beach is inside the Florida Building Code Wind-Borne Debris Region, so every opening needs impact-rated glazing or approved shutters. The county wind-speed maps put oceanfront and Intracoastal parcels at roughly 170 mph and up, stepping down toward the mid-160s inland toward I-95. The exact design speed depends on your parcel and the code edition, so we check your address before specifying products.

Will my lot be in a historic district?

Possibly. Delray Beach has five local historic districts: Old School Square Historic Arts District, Del-Ida Park, Nassau Park, the Marina Historic District and the West Settlers Historic District. In them the Historic Preservation Board reviews exterior work before a permit is worth filing. We check your address for a district and prepare the submittal it needs.

Do the gated communities in Delray Beach have their own approval?

Yes. Large gated communities such as Kings Point and Rainberry Bay run their own architectural approval, and exterior work typically routes through the association even when the owner pays for it. We find out which review applies to your lot before we finalize a design.

What flood zone and setbacks apply to my Delray Beach lot?

Flood zone is assigned parcel by parcel on FEMA flood maps and sets the finished-floor elevation. Setbacks, height and lot coverage come from the City of Delray Beach Land Development Regulations for your zoning district. We check both against your survey before design, not by neighborhood.

Are you licensed to build new homes in Delray Beach?

Yes. Bell Engineering and Construction Corporation holds Florida State-Certified General Contractor license CGC1528750, which allows us to contract anywhere in Florida. We are an EPA Lead-Safe Certified Firm (#NAT-F122701-2), BBB A+ accredited, and every job has a written one-year workmanship warranty. We hold a Palm Beach County Business Tax Receipt but not a Delray Beach municipal receipt.
