Why a Jupiter Closing Asks for One

An estoppel certificate is the association's written statement of what one unit or lot owes: assessments due and the date they are paid through, any special assessment, any transfer or capital fee and whether a violation is on file. In Jupiter the request usually arrives with a contract already signed. Oceanfront and Intracoastal condominium buildings, the Loxahatchee River communities and the gated golf neighborhoods all sell through title agents and lenders who will not close without it.

Two Florida statutes govern the subject, one for condominiums (Chapter 718) and one for homeowners associations (Chapter 720, section 720.30851 for the certificate). Both set who may ask, the ten-business-day deadline, what the association may charge and how long the certificate stays valid. The statutes are amended often, so confirm the current rule with your association attorney.

What Is Particular to Jupiter

The permitting authority. Jupiter is an incorporated town with its own Building Department at 210 Military Trail and an online portal for applications and inspections; it is separate from the Palm Beach County Building Division. The certificate does not cover permits, but the Town's records do, and an old roof or window permit left open on a Jupiter property tends to surface in the title search. Ask the Town, not the association.

The housing stock. Jupiter runs from the older coastal enclaves near the inlet and along the Loxahatchee River, built in the 1970s and 80s, to Abacoa, a master-planned neighborhood begun in the mid-1990s with deed restrictions and an architectural review board, and to gated golf communities such as Jonathan's Landing and Admirals Cove that run their own boards. Each association keeps its own ledger, so each certificate reads differently. Jupiter Farms, on the rural west side, is mostly acreage: some lots belong to a homeowners association and some do not, and a seller should confirm which before asking for a certificate.

Wind and water. Jupiter sits in the Wind-Borne Debris Region, and oceanfront and river lots can fall under Coastal Construction Control Line provisions. For an estoppel that matters indirectly: buildings on the water carry larger insurance, roof, seawall and concrete budgets, so special assessments and capital fees deserve the buyer's first read.

The Accounting Behind the Certificate

A certificate is fast to produce when the books are in order and slow when they are not. BeacCorp keeps owner ledgers, posts assessments as they arrive, tracks special assessments and fines against the right account and prepares the monthly financial statement the board reviews. When a request comes in, the figures are already there and can be checked against the ledger instead of rebuilt.

That is why the work sits under a licensed Community Association Manager. Randolph Scott Bell holds CAM34850 individually and the firm holds CAB3255. He lives and works in the same community he manages and attends association meetings himself. We make no promise about how fast any one certificate will be ready, because the statute sets the deadline and the records set the pace.

For a Seller, a Buyer, a Title Agent or a Board

Sellers: request the certificate once the contract is signed, read it as the buyer will and clear anything that shows. Buyers: look for special assessments and transfer fees first. Title agents and closing attorneys: send the request in writing with the closing date and where to send the certificate. Boards: keep the ledger current and decide in advance who signs and sends certificates. Read HOA and condo management in Palm Beach County or the Jupiter reserve study page if the association's finances are the real question.

This is general information for Florida boards and owners, not legal advice. Confirm current deadlines, fee caps and thresholds with your association attorney before you act.

Estoppel Certificates in Jupiter — FAQ

How long does it take to get an estoppel certificate for a Jupiter HOA or condo?

Florida law sets the deadline: the association has ten business days from a proper written request. That deadline comes from the statute, not from a promise by us, and how quickly a certificate is ready also depends on how current the association's ledger is. If you are under contract, send the request as soon as the contract is signed.

Who pays the estoppel fee on a Jupiter sale?

The statute lets the association charge a capped fee, and by default the fee is the cost of the owner or the party who asked. Who pays at the closing table is a matter of the sales contract and the title agent's statement. The cap is adjusted over time, so this page prints no figure; ask the association or your attorney for the current amount on the day you request it.

Is an estoppel certificate required to sell a home or condo in Jupiter?

Florida does not make a sale impossible without one, but title agents and lenders ask for it on almost every association sale, because it is the only written statement of what the seller owes the association. Selling inside a Jupiter condominium or homeowners association without it leaves the closing attorney guessing at the numbers.

Does Jupiter's Building Department show up on an estoppel certificate?

No. The certificate speaks for the association's own records: assessments, fees and violations. An open permit sits with the Town of Jupiter Building Department, which runs its own office at 210 Military Trail and an online portal, and it tends to appear in a title search. A seller with an older roof, window or water-heater permit should ask the Town about it separately.

Do oceanfront and Loxahatchee River condos in Jupiter have different estoppel issues?

The certificate itself is the same, but the numbers behind it can differ. Waterfront buildings often carry larger insurance, seawall, roof and concrete-restoration budgets, so a special assessment or a funded-reserve question is more likely to be on the buyer's mind. Read the certificate for special assessments and capital fees first.

Are Jupiter Farms properties covered by an estoppel certificate?

Only if the parcel belongs to a homeowners association. Some Jupiter Farms lots sit inside an association and some do not, so a seller should first confirm whether one exists and whether it collects assessments. Where there is none, there is no association certificate to request.

What is a dirty estoppel?

It is informal shorthand for a certificate that shows a problem: unpaid assessments, a special assessment, fines or an open violation. The balance has to be cleared at or before closing, so a seller does better to request the certificate early and fix the issue than to find it in the last week.

Does BeacCorp provide estoppel certificates in Jupiter?
